A mistrial might have been declared in Andrea Rossi’s lawsuit against Industrial Heat, Cherokee Partners and Tom Darden. Rossi is claiming that Darden broke a contract to buy his ecat low energy nuclear reaction (LENR) technology. Darden and company are claiming that ecat does not work.

Blogger Abd ulRahman Lomax reported that the mistrial was declared on June 29, 2017, because three of the 10 jurors seated asked to be excused. Instead of proceeding with trial; which was supposed to begin on June 26, lawyers for both sides will meet with United States Judge Cecilia Altonaga to go over juror questions.

A jury had apparently been seated on June 28, and heard opening arguments but a mistrial was declared for unspecified reasons on June 29, Law 360 reported. My guess here is that the jurors are trying to get out of juror duty by claiming conflict of interest or something. A lot of Americans including myself have pulled that ruse in the past. A big reason why jurors do that is jury duty pays far less than their jobs.

I don’t know how accurate this information is, Lomax is apparently attending the trial but he’s not a lawyer or a reporter. His reports; which are incomplete, are being posted at Cold Fusion Community.

Something else to remember is that civil jury trials are actually pretty rare in America. Such matters are usually settled via informal negotiation long before reaching a jury.

They might be all we have because one of the better blogs e-catworld is partially down right now. It did identify a lawyer for Rossi; Brian Chaiken on June 29. Chaiken’s Facebook Page identifies him as a founding partner at Annesser & Chaiken PLLC in Fort Lauderdale.

Rossi Silent For Trial

One source we will not be able to count upon for data is Andrea Rossi. On June 26, 2017; Rossi’s blog contained this message:

“DEAR READERS OF THE JONP:

FROM TODAY UNTIL JULY 24TH, DAY OF TRIAL END, ANDREA ROSSI WILL NOT COMMENT ON THIS BLOG, THAT REMAINS AT YOUR DISPOSAL AS A FORUM.”

Since the trial might be over or postponed we should watch the Journal of Nuclear Fusion (JNOP); Rossi’s blog, closely because he might start posting again.

My guess is that we can expect several more days or weeks of this conclusion before this trial ends or something happens. So don’t hold your breath, we might see a working ecat before this trial ends.
